    Question [QUESTION] The new marketplace rule

    Hello,
    Just found out that there was a new marketplace rule stating you can't sell things that are illegal. So does that mean now that we can't sell Rapidshare accounts anymore?

    If yes, could it be possible to create a private marketplace subforum where it is allowed to sell/trade accounts? I'd be willing to manage new members to make sure they obey the rules (F.E. minimum post count etc )

    selling such accounts is illegal by the service provider aka RapidShare itself. I don't think it will be allowed in private forum

    There is a difference between "illegal" and "against some terms of service document."

    For example, I might make a rule that says all NetBuilders must wear red underwear. If you log on to NetBuilders without wearing red underwear, you are in violation of the NB TOS -- but that doesn't make it illegal.

    I do not know if selling RapidShare accounts is illegal. Rapidshare is some sort of file hosting service? How do we at NetBuilders verify if a seller is a RapidShare "verified reseller"? We're really not in the business of enforcing other peoples terms of service.

    My current view is to allow RapidShare account selling until someone shows that it is illegal.

    I violated the underwear rule so do I get banned now?

    But I agree with Will. Rapidshare accounts are traded everywhere so why not here? Besides rapidshare itself stores warez files, copyrighted material. When someone points to it, they just remove that 'particular' file. So why don' they verify each and every uploader and each and every file before uploading it on their servers.

    Similarly, like Will said, I don't think it's any forum's responsibility to check whether the accounts sold are against any sites' TOC. If RS complains, forum admin can just ban that particular member.

    I suppose they are illegal as most of the trade is of PHISHED rapidshare account ..

    So once you buy the account you use it for few days and bam its gone because real owner has filed a complaint to rapidshare with their PP case no and have gotten back their account and you are left with nothing

    The scamming rate with Rapidshare is very high

    Even if the same is generated by points the user can get those points back by filing a simple complaint

    This has been my experience so i had to buy real account

    I can also buy something from you then file a PayPal dispute and get my money back. Leaving you with nothing at all... I can offer someone a free download of a script, which really carries a hidden keylogger, which I'll use to get your GoDaddy account information - then I'll sell all of your domains, and no one here will know.     So what I think has been suggested, or rather implemented, is that we do not allow activities that, in themselves, are illegal, such as selling cocaine and heroin or the trading of child pornography. These are illegal no matter what, whereas a RapidShare account may have been illegally obtained, but may also have been legally obtained. Since there is no way of knowing, and the selling of a RapidShare account in itself is not illegal, it will be allowed.

    @Kovich - as we know that Paypal refuses to charge back in case of virtual goods . so i suppose it would be no good

    and what i mean in case of RS is it involves high amount of risk to buy from sellers on forums but illegality is an issue that can be argued upon

    Yes, but that was just an example. Doesn't have to be for a virtual good.

    Well, there are the obvious things... :P
    Firearms. Ammunition. Explosive Ordinances. Stolen Identities. Narcotics, Steroids and all other controlled substances.
    Paraphernalia related to controlled substances and drugs. Child Pornography.

    Then the other general things such as:
    WaReZ. Copyrighted Material, which you do not have the right to sell. Etc.
