Forum Admin Gets Suspended Sentence for Not Deleting Offensive Posts

Website owner gets suspended jail term sex-scene pictures posted

The owner of a message-board website got a suspended one-year jail term and a fine of Bt20,000 after a user posted sex-scene pictures of a Thai woman on his site.

The Criminal Court found Pongwit Singsun 23, guilty of violations of the Computer-Related Crimes Act for allowing his website to be used to damage another person's reputation.

Public prosecutors charged that the crime took place from October 6 to November 30.

A user posted the sex-scene pictures of a woman in Nakhon Sawan, who alerted police.

The court initially sentenced Pongwit to years and fine of Bt40,000 but commuted the penalties by half after he pleaded guilty.

The court later suspend the one-year jail term and put him on probation for two years during which he must report to probation officials for eight times. He is also required to carry out social service for 48 hours.

In the future, we may decide where to host our forums based upon the local laws in each jurisdiction -- and we may decide where to live based upon the same criteria.

internet law in thailan is simlar to china. One guy was arrested when spammer flooded his forum with porn. He had no chanse to delete them all and the police came. They can raid your house with no court warrent and you can not use proxy or have porn your home computer.

This is a big one, I think a lot of US people especially are under the assumption that their site isn't hosted in the US, they aren't liable/bound by US laws when in reality they are.

If you're going to do something that's against the law where you live, simply picking a host/server that's else where isn't going to save you.

I think this also goes to show you to have some common decency and if someone requests their pictures removed, to simply remove them and not throw some huge fuss over it

I hope the material you use is not a copyright material or else these porn stars will come knocking on your doors for want of royalty!
