Where is the trade mark registered company located as well as the owner of the domain? Do you believe that he is a cyber squatter?
I owned a trademarked .in and got a letter from a lawyer in india telling me I better hand over the domain or it will get ugly. The owner of the trademark just happened to be the biggest media company in the world so needless to say I dropped the domain and emailed the lawyer to let them know it was free for them to grab.
I'll see if I can dig up the letter tomorrow and if I can I will pm you what it said so maybe you can send a similar letter.

Even though there is a trademark the domain owner may have a right to use the domain depending on the nature of the trademark. A lot would depend on whether the domain owner is violating the trademark or it can be proven that he's cybersquatting.

I got .net.in
When .in started they were giving to the registered company only, after made it open many have booked three letter domains for profit expatiation.
Let's see waiting for other opinions, as the same thread is created at DP also.

You can file an UDRP and may be able to win if you can show that the domain was purchased or being used in bad faith. I beleive it costs around $1300 plus attorney fees to file. It may be wiser to see if its possible to purchase the domain for less.
Also, are there any requirements connected to the .in tld like having an India presence?
